Text Messaging (SMS) — Opt-In, Use, and Your Rights

If you request an initial consultation and choose to provide your mobile phone number and opt in to text messaging, Middle Way Psychotherapy PC ("Middle Way") may send you SMS text messages solely to coordinate that initial consultation. Providing your mobile number and opting in to text messaging is always optional. You do not need to consent to receive text messages in order to request a consultation, schedule care, or receive services from Middle Way.

What we use SMS for

We use SMS narrowly — only to coordinate your initial consultation after you submit a consultation request through our website. Typical messages include:

  • Confirming that we received your consultation request
  • Offering or confirming a time for your initial consultation
  • Responding to a brief scheduling question you have sent us about that consultation

We do not send marketing or promotional text messages. We do not use SMS for ongoing appointment reminders, ongoing care coordination, or any clinical communication. Ongoing communication with your clinician takes place inside your clinician relationship, through our secure client portal, or by other HIPAA-appropriate means. We do not send clinical content, treatment information, diagnostic information, or other protected health information (PHI) by SMS, because standard SMS is not a secure channel.

Message frequency and rates

Message frequency is low and tied to your consultation request — typically one to three messages to coordinate your initial consultation, and none after that. Message and data rates may apply, depending on your mobile plan. Middle Way does not charge for text messages.

How to opt out or get help

You can stop text messages at any time by replying STOP to any message you receive from us. You will receive one confirmation message and no further texts. You can reply HELP to any message for support, or contact us directly at 718.635.1228 or info@middlewayhealing.com. Opting out of text messages will not affect your ability to receive care.

How your mobile information is handled

The mobile information you provide in connection with SMS opt-in — including your mobile phone number and your consent — will not be shared with third parties or affiliates for marketing or promotional purposes at any time. We do not sell mobile opt-in data or text-messaging consent data. We do not share this information with lead generators.

We use Twilio, Inc. as our SMS delivery vendor. Twilio processes your mobile number and message content solely to deliver the text message on our behalf, under a contract that restricts use of the data to that service. We may use a workflow automation vendor (for example, Zapier) to route form submissions to the SMS system; these vendors process the information only to deliver the service we have contracted for.

Age requirement

You must be at least 18 years old to opt in to text messaging from Middle Way. If messages about a minor's care need to be sent, they will be sent to a parent or legal guardian who has opted in.

Changes to this section

We may update this SMS section from time to time. Material changes to how we use SMS, what categories of messages we send, or how we handle mobile opt-in data will be posted on this page with a revised "Last Updated" date. Your continued participation in text messaging after a change constitutes acceptance of the update; if you do not accept a change, you can reply STOP at any time.
